Welcome to Livenormad. These Terms of Use, Sale, Service, Installation Coordination, Design, Rendering, Custom Production, Auction, Final Sale, and Platform Terms are a binding agreement between Livenormad Inc. and each person, business, customer, homeowner, buyer, seller, real estate agent, brokerage, affiliate, referral partner, contractor, installer, visitor, user, or account holder who accesses, uses, registers for, purchases from, receives services from, communicates with, or otherwise deals with Livenormad.

These Terms apply to all Livenormad websites, dashboards, portals, catalogues, quote systems, product pages, commercial platforms, real estate partnership platforms, wall quotation tools, online ordering systems, custom furniture services, full-home furnishing services, feature wall services, rendering services, installation coordination, production services, auction and final sale channels, referral programs, affiliate programs, communication channels, and any other service or product offered by Livenormad now or in the future.

By accessing or using any Livenormad website, platform, dashboard, quote tool, catalogue, service, product, invoice, proposal, quotation, email communication, order form, payment link, auction listing, final sale listing, or customer portal, you confirm that you have read, understood, accepted, and agreed to be bound by these Terms. If you do not agree, you must not use Livenormad's websites, platforms, services, products, portals, quotation systems, auction channels, or customer dashboards.

1. Important Legal Notice

These Terms contain important provisions that limit Livenormad's liability, allocate responsibility for third-party contractors and installers, govern deposits, cancellations, delays, custom production, auction purchases, final sale purchases, dashboard approvals, force majeure events, disputes, refunds, product variations, website use, intellectual property, and platform access.

Nothing in these Terms is intended to exclude, restrict, or waive rights that cannot legally be excluded, restricted, or waived under applicable law. Where any provision conflicts with mandatory law, the provision applies only to the maximum extent permitted by law and will be modified only to the minimum extent necessary to make it enforceable.

2. Right to Change These Terms at Any Time

Livenormad may update, revise, amend, replace, suspend, withdraw, or modify these Terms, any policy, any service description, any product description, any program, any pricing model, any offer, any dashboard feature, any platform feature, any installation coordination process, any referral or affiliate program, any auction process, and any other part of its business, website, or service model at any time.

The updated version becomes effective when posted, published, emailed, uploaded to a dashboard, incorporated into a quotation, or otherwise made available, unless a different effective date is stated. Your continued access to or use of Livenormad's websites, platforms, dashboards, products, services, quotation systems, communications, or programs after an update means you accept the updated Terms.

3. Scope of Livenormad's Business

Livenormad may provide, coordinate, facilitate, advertise, arrange, or recommend custom furniture manufacturing, full-home furnishing packages, bedroom packages, master bedroom packages, direct-from-manufacturer production, product catalogue access, quote and order management, material and finish selection, production updates, dashboard access, product verification workflows, shipping and logistics coordination, feature wall supply, wall panel supply, TV wall materials, acoustic panels, WPC panels, UV marble sheets, profile lights, consoles, interior design concepts, photorealistic renders, virtual concepts, Livenormad Advantage brokerage and agent partnership services, home preparation services, referral programs, affiliate programs, auction sales, warehouse sales, showroom sales, overstock sales, third-party store sales, commercial project support, and third-party installation recommendations.

Livenormad may modify, discontinue, expand, restrict, rebrand, rename, replace, or restructure any service, product line, sales channel, auction channel, platform, or program at any time.

4. User Categories

Livenormad may serve individual homeowners, new homebuyers, residential customers, commercial buyers, sole proprietors, corporations, builders, developers, interior designers, real estate agents, brokerages, sellers, buyers, referral partners, affiliate marketers, contractors, installers, vendors, suppliers, and other authorized users.

Certain services may be available only to selected users, invite-only users, approved users, business users, brokerage partners, commercial users, or users who satisfy Livenormad's verification requirements.

5. Age and Legal Capacity

You must be at least the age of majority in your province, territory, state, or country of residence to enter into a binding contract with Livenormad, unless a parent, guardian, authorized representative, or legally responsible person is entering into the transaction on your behalf.

By using Livenormad's services, you represent and warrant that you have legal capacity to enter into these Terms and authority to bind any business, brokerage, corporation, partnership, seller, buyer, homeowner, or other entity on whose behalf you act.

6. Account, Dashboard, and Platform Access

Livenormad may provide access to accounts, dashboards, portals, quotation tools, catalogues, brokerage dashboards, agent portals, design dashboards, request status tools, billing summaries, associate invitation tools, production dashboards, auction dashboards, or other platform features.

You are responsible for maintaining login confidentiality, monitoring dashboard updates, keeping contact information current, reviewing invoices and approvals, preventing unauthorized account use, and responding promptly to production, payment, delivery, and verification requests.

Livenormad may treat any approval, instruction, upload, acceptance, confirmation, signature, payment, bid, auction purchase, design approval, material selection, product selection, or communication submitted through your account, email, phone number, dashboard, payment link, or other verified channel as valid and authorized.

7. Electronic Agreement, Signatures, and Records

You agree that electronic records, electronic communications, electronic signatures, click-wrap acceptance, checkbox acceptance, typed names, email confirmations, text confirmations, dashboard approvals, online payments, invoice acceptances, auction bids, final sale purchases, and other digital actions may be used to form, confirm, modify, approve, or evidence agreements between you and Livenormad.

To the maximum extent permitted by applicable law, these electronic records have the same legal effect as paper records and handwritten signatures.

8. Quotations, Estimates, and Order Acceptance

Any quotation, estimate, proposal, invoice, online price, catalogue price, package price, render-based price, wall quotation, auction listing, auction bid acceptance, commercial proposal, or dashboard quote provided by Livenormad is subject to review, correction, adjustment, availability, measurement verification, production feasibility, shipping confirmation, tax calculation, supplier confirmation, installation feasibility, and final acceptance by Livenormad.

A quotation, listed price, auction listing, or order number does not constitute final acceptance unless Livenormad confirms acceptance in writing or begins processing the order. Livenormad may refuse, cancel, suspend, revise, or reject any order or auction transaction for pricing errors, product unavailability, suspected fraud, failure to meet minimum order quantity, payment issues, unsafe conditions, or any other reasonable business or compliance concern.

9. Pricing, Taxes, Shipping, Duties, and Additional Costs

Unless expressly stated otherwise in writing, prices may exclude GST/HST, provincial taxes, shipping, freight, customs duties, import charges, storage, delivery, installation, assembly, insurance, financing charges, credit card fees, third-party service fees, site preparation, electrical work, permits, access costs, elevator booking fees, condo move-in fees, parking costs, crane or lift fees, waste disposal, and other additional charges.

You are responsible for all applicable taxes, duties, shipping, delivery, handling, installation, storage, site access, and related charges. Livenormad may require payment of additional amounts before production, release, delivery, installation, or final completion.

10. Advertising Claims, Savings Claims, and Product Representations

Livenormad may advertise estimated savings, retail comparisons, market comparisons, package values, product benefits, design outcomes, sale timelines, factory-direct benefits, auction deals, overstock discounts, final sale pricing, or other marketing claims.

Savings, outcomes, timelines, and comparisons vary by product, supplier, location, customization, shipping, installation, retail comparison, timing, market conditions, and final purchase details. Renders are conceptual and may not exactly match final products, lighting, proportions, colours, dimensions, finishes, or property conditions.

11. Minimum Order Quantity

Certain products and custom orders are subject to minimum order quantities, minimum cubic metre requirements, minimum order values, minimum package requirements, minimum production quantities, or minimum fulfillment thresholds.

Where a customer reduces an order below an applicable minimum, Livenormad may refuse to proceed, reprice the order, maintain the original minimum charge, round the order up to the applicable minimum, require additional items, convert deposits to earned fees, apply cancellation terms, or offer alternative fulfillment options at Livenormad's discretion.

12. Custom Orders

Many Livenormad products and packages are custom, special-order, made-to-order, project-specific, imported, manufactured to customer preference, or produced based on selected designs, materials, colours, dimensions, finishes, renders, or project requirements.

Once a custom order is accepted and Livenormad has begun design, sourcing, supplier coordination, procurement, production, logistics planning, rendering, or manufacturing, the order may become non-refundable and non-cancellable except as required by applicable law or expressly agreed in writing by Livenormad.

13. Deposits

Livenormad may require consultation deposits, design deposits, production deposits, procurement deposits, custom order deposits, installation coordination deposits, service deposits, package deposits, brokerage program deposits, auction deposits, or other upfront payments.

Unless expressly stated otherwise in writing, deposits may compensate Livenormad for consultation time, design work, render preparation, administrative review, product sourcing, supplier communication, quote preparation, material selection support, production slot reservation, procurement, logistics planning, dashboard setup, installation scheduling, project management, and other work performed by Livenormad.

A deposit may become non-refundable once Livenormad begins work, incurs costs, reserves production capacity, creates designs, prepares renders, engages suppliers, starts procurement, creates quotations, assigns staff, or performs services.

14. Payment Terms

Livenormad may require full payment, staged payment, deposit payment, balance payment, milestone payment, financing approval, or auction purchase payment before providing or completing services.

Unless expressly agreed otherwise in writing, deposits are due before work begins, production may not begin until required payment is received, balances may be due before shipment or delivery, and Livenormad may pause work or withhold delivery if payment is late.

15. Financing

Where financing options are made available, financing is provided by third-party financing providers, not by Livenormad, unless expressly stated otherwise in writing. Livenormad is not responsible for financing approval or denial, interest rates, charges, payment schedules, credit checks, provider delays, provider errors, or financing contract terms.

An order may not proceed until financing approval is confirmed and Livenormad receives payment or confirmation acceptable to Livenormad.

16. Design, Rendering, and Visual Concept Services

Livenormad may provide design concepts, renders, visual presentations, room layouts, lifestyle images, 3D concepts, virtual tours, furnishing concepts, wall panel concepts, feature wall concepts, and other visual materials. All such materials are for visualization, planning, marketing, and conceptual purposes only unless expressly stated otherwise in writing.

Unless expressly transferred in writing, all renders, designs, floor plan interpretations, visual concepts, layouts, product combinations, creative ideas, drawings, images, digital files, and presentation materials created by or for Livenormad remain the intellectual property of Livenormad or its licensors.

17. Customer-Provided Measurements, Photos, Floor Plans, and Information

You are responsible for ensuring that all measurements, floor plans, photos, videos, property details, room dimensions, wall dimensions, ceiling heights, access details, electrical details, site conditions, delivery restrictions, and other information provided to Livenormad are accurate, complete, and current.

Livenormad may rely on information you provide and is not responsible for errors, delays, additional costs, fit issues, installation issues, redesign costs, remake costs, access issues, or failed delivery arising from inaccurate, incomplete, outdated, misleading, or missing information.

18. Material Selection, Substitutions, and Variations

Materials, finishes, colours, fabrics, wood grains, stone patterns, metals, veneers, panels, lighting components, and other product elements may vary from samples, renders, catalogues, photos, or prior production batches.

Minor variations do not constitute defects. Livenormad may substitute materials, components, finishes, suppliers, production methods, or equivalent alternatives where the original item is unavailable, discontinued, delayed, impractical, non-compliant, defective, unsafe, or commercially unreasonable to obtain.

19. Customer Approvals

You may be required to approve designs, renders, product lists, dimensions, materials, colours, finishes, quotations, invoices, production photos, product videos, installation dates, delivery dates, substitutions, auction terms, final sale terms, and final order details.

Once approval is given, Livenormad may rely on that approval to proceed. Changes requested after approval may be refused or may result in additional charges, delays, redesign fees, production fees, remake fees, supplier charges, administrative charges, shipping charges, or cancellation consequences.

20. Auction, Overstock, Store Purchase, and Final Sale Items

From time to time, Livenormad may sell products through auctions, auction-style promotions, limited inventory sales, showroom sales, overstock sales, warehouse sales, clearance events, special promotions, third-party stores, partner stores, marketplace channels, or other resale or discounted sales channels.

This may include bedroom packages, master bedroom sets, furniture sets, wall panels, feature wall materials, showroom items, cancelled-order items, overstock inventory, imported inventory, display items, one-time promotional bundles, and other limited-availability products.

Unless expressly stated otherwise in writing by Livenormad, all items purchased through an auction, auction-style sale, warehouse sale, showroom sale, overstock sale, clearance sale, final sale promotion, third-party store, partner store, marketplace channel, or other discounted resale channel are sold on a FINAL SALE basis.

Final sale means no cancellation, no return, no exchange, no refund, no price adjustment, no post-purchase discount, no change-of-mind cancellation, and no substitution unless approved by Livenormad in writing.

Customers are responsible for reviewing all product descriptions, dimensions, included items, photos, videos, materials, colours, finishes, delivery terms, installation terms, auction terms, and conditions of sale before purchasing auction or final sale items.

Unless expressly included in writing, auction and final sale pricing does not automatically include delivery, installation, assembly, wall panel installation, third-party contractor fees, storage, taxes, shipping, financing charges, or other additional services.

Nothing in this section limits any non-waivable right that a customer may have under applicable consumer protection law.

21. Production Timelines

Any production timeline, shipping timeline, delivery timeline, installation timeline, render timeline, quotation timeline, auction pickup timeline, or completion timeline provided by Livenormad is an estimate only unless expressly guaranteed in writing by an authorized officer of Livenormad.

Delay does not automatically entitle you to cancellation, refund, chargeback, damages, compensation, or rejection of the order except where required by applicable law.

22. Quality Control, Inspection, Repair, Remake, or Replacement

Livenormad may inspect products before release, delivery, or installation. If Livenormad determines that a product does not meet internal standards, Livenormad may repair, adjust, remake, replace, improve, or withhold the product before delivery.

Livenormad's decision to conduct inspection, repair, remake, replacement, or quality review is part of its quality control process and does not automatically constitute breach, defect, delay liability, or grounds for refund.

23. Shipping, Delivery, and Risk of Loss

Shipping, freight, delivery, customs, and logistics may be performed by third-party carriers, freight forwarders, warehouses, trucking companies, couriers, customs brokers, or delivery providers. Livenormad is not responsible for issues caused by third-party carriers or events beyond its control.

You must inspect products promptly upon delivery and report any visible damage, missing items, or delivery concerns within the timeframe stated by Livenormad or, if no timeframe is stated, within 48 hours of delivery.

24. Storage Fees and Customer Delay

If goods are ready for delivery, pickup, shipment, installation, or release and you fail to pay the balance, approve release, provide access, schedule delivery, respond to communication, or accept delivery, Livenormad may charge storage fees, administrative fees, rescheduling fees, carrier fees, warehouse fees, insurance fees, or other related costs.

If you delay acceptance for an unreasonable period, Livenormad may treat the order as abandoned, resell non-custom goods where practical, apply deposits or payments against costs, and pursue any unpaid balance or loss, subject to applicable law.

25. Installation Services and Third-Party Installers

Livenormad may provide names, contact information, introductions, recommendations, referrals, or access to third-party installation teams, contractors, trades, handymen, electricians, builders, designers, or other service providers. Unless expressly stated otherwise in a written contract signed by Livenormad, such third-party installers and contractors are independent third parties and are not employees, agents, servants, partners, joint venturers, legal representatives, or controlled subcontractors of Livenormad.

Any third-party installation team recommended, introduced, listed, or preferred by Livenormad is provided as a convenience only. You are solely responsible for vetting, selecting, approving, hiring, supervising, permitting, granting access to, and contracting with any third-party installer or contractor who enters or performs work at your property.

Before allowing any installer or contractor to work in or on your property, you are responsible for verifying that the installer or contractor has all documentation you require, including business licence, insurance, commercial general liability coverage, workers' compensation coverage, safety documentation, trade qualification, electrical qualification, permits, references, and any other documents, approvals, or qualifications you consider necessary.

To the maximum extent permitted by law, Livenormad is not liable for any claim, loss, injury, death, property damage, delay, cost, repair, deficiency, accident, insurance issue, permit issue, code issue, employment issue, workers' compensation issue, or dispute arising from or connected to any third-party installer or contractor, even where that installer or contractor was recommended, introduced, preferred, or listed by Livenormad.

26. Site Readiness for Installation

Where installation is arranged, whether through Livenormad or a third party, you are responsible for ensuring the site is ready, safe, accessible, clean, dry, structurally suitable, legally available, and free from hazards.

Livenormad is not responsible for hidden conditions, unsafe walls, weak structures, electrical issues, plumbing issues, mould, asbestos, concealed wires, concealed pipes, uneven walls, water damage, improper framing, inaccessible areas, or site conditions that prevent or complicate installation.

27. Electrical, Structural, Permit, and Code Matters

Unless expressly stated in writing, Livenormad does not provide licensed electrical, engineering, architectural, structural, plumbing, gas, HVAC, or permit services. You are responsible for determining whether your project requires permits, engineering review, electrical work, code compliance, condo approval, landlord approval, municipal approval, or other approvals.

Livenormad is not liable for regulatory violations, permit failures, code violations, electrical issues, structural issues, landlord disputes, condo disputes, municipal enforcement, or unsafe work performed by third parties.

28. Livenormad Advantage, Real Estate Partnerships, Agent Programs, and Brokerage Use

Livenormad may offer invite-only or approved-access real estate partnership programs, including the Livenormad Advantage, brokerage dashboards, associate invitations, listing preparation tools, furnishing concepts, feature wall concepts, buyer customization workflows, render requests, and related services.

Livenormad is not a real estate brokerage, mortgage brokerage, appraisal firm, law firm, lender, insurer, or financial advisor unless expressly stated otherwise in writing. Livenormad does not guarantee that a property will sell, sell faster, sell for more money, attract buyers, or qualify for financing.

29. Free Feature Walls, Promotions, and Conditional Offers

Livenormad may offer free feature walls, included feature wall materials, promotional pricing, package incentives, brokerage incentives, referral credits, affiliate commissions, discounts, bundled services, or other promotional offers.

All promotions are conditional and subject to written terms, availability, eligibility, order size, package type, payment status, project location, installation feasibility, and Livenormad approval. If a qualifying condition is not satisfied, Livenormad may charge for the promotional item, remove it, convert it to a paid item, or adjust the package price.

30. Referral Program

Livenormad may offer a referral program. Referral rewards, if any, are earned only when all conditions stated by Livenormad are satisfied, including completion of a qualifying purchase, full payment, no cancellation, no refund, no reversal, no chargeback, no dispute, and proper recording of the referral before the transaction.

Livenormad may modify, suspend, or terminate the referral program at any time.

31. Affiliate Program

Livenormad may operate an affiliate program. Affiliates are independent marketers and are not employees, agents, partners, franchisees, or legal representatives of Livenormad.

Livenormad may withhold or cancel commissions connected to fraud, cancelled transactions, refunds, chargebacks, misleading advertising, non-compliance, or reputational harm.

32. Third-Party Suppliers, Manufacturers, Carriers, and Service Providers

Livenormad may work with third-party manufacturers, suppliers, factories, warehouses, logistics providers, freight forwarders, customs brokers, carriers, designers, installers, contractors, consultants, financing providers, software providers, auction platforms, marketplace providers, and other third parties.

Livenormad is not liable for third-party acts, omissions, delays, negligence, errors, defects, shortages, price increases, customs issues, shipping issues, production delays, material substitutions, strikes, insolvency, accidents, or failures, except to the extent liability cannot be excluded by law.

33. User Content, Reviews, Photos, Videos, and Project Media

By providing content to Livenormad or tagging Livenormad online, you grant Livenormad a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable licence to use, reproduce, publish, edit, display, distribute, advertise, and create derivative works from such content for marketing, operational, educational, sales, legal, training, and promotional purposes, subject to applicable privacy laws.

You represent that you own or have permission to provide the content and that the content does not violate any third-party rights.

34. Intellectual Property

All Livenormad websites, designs, software, dashboards, catalogues, workflows, renders, images, trade names, logos, text, videos, layouts, systems, product descriptions, quote tools, wall quotation tools, auction materials, commercial platform features, business processes, pricing structures, marketing concepts, service models, documents, and related content are owned by Livenormad or its licensors.

You may not copy, reproduce, modify, reverse engineer, scrape, sell, distribute, republish, imitate, frame, download, commercialize, or create derivative works from Livenormad intellectual property without written permission.

35. Acceptable Use

You agree not to use Livenormad platforms unlawfully, misrepresent your identity, provide false information, upload harmful code, attempt unauthorized access, scrape or copy data, interfere with platform security, harass staff or contractors, abuse referral or affiliate programs, make false claims about Livenormad, circumvent payment obligations, commit fraud, manipulate auctions, submit false bids, or harm Livenormad's business, reputation, systems, customers, suppliers, or partners.

Livenormad may suspend or terminate access for any violation or suspected violation.

36. Privacy and Data

Your use of Livenormad's services may involve collection, use, storage, processing, and disclosure of personal information, business information, project information, property information, payment information, order information, auction information, and communication records.

Livenormad may share necessary information with suppliers, manufacturers, carriers, installers, contractors, financing providers, payment processors, professional advisors, legal authorities, or other parties reasonably required to provide services or protect Livenormad's rights.

37. Disclaimers

To the maximum extent permitted by law, Livenormad provides its websites, platforms, dashboards, renders, quote tools, catalogues, auction listings, services, and information on an as-is and as-available basis.

Livenormad does not guarantee uninterrupted websites, error-free dashboards, product availability, material availability, exact render matches, guaranteed production dates, guaranteed shipping dates, guaranteed installation availability, third-party contractor performance, real estate outcomes, financing approval, or permanent availability of any service.

38. Limitation of Liability

To the maximum extent permitted by applicable law, Livenormad and its directors, officers, employees, agents, affiliates, suppliers, licensors, service providers, contractors, successors, and assigns will not be liable for indirect, incidental, special, consequential, punitive, exemplary, economic, or aggravated damages, including loss of profits, loss of revenue, loss of business opportunity, loss of property value, loss of use, delay damages, emotional distress, inconvenience, reputational harm, data loss, financing loss, real estate loss, or third-party claims.

To the maximum extent permitted by law, Livenormad's total cumulative liability for any claim arising from or related to your use of Livenormad's websites, platforms, products, services, orders, renders, installations, referrals, auctions, dashboards, or transactions will be limited to the amount you paid to Livenormad for the specific product or service giving rise to the claim in the six months preceding the event, or $100, whichever is greater. This limitation does not exclude liability that cannot legally be excluded.

39. Indemnity

You agree to indemnify, defend, and hold harmless Livenormad and its directors, officers, employees, agents, affiliates, suppliers, contractors, service providers, successors, and assigns from and against claims, losses, damages, liabilities, penalties, costs, legal fees, expenses, demands, actions, proceedings, or settlements arising from your breach of these Terms, misuse of services, inaccurate information, unauthorized approvals, failure to pay, failure to verify measurements or site conditions, failure to vet third-party installers, auction misuse, violation of law, infringement of third-party rights, user content, real estate representations, or disputes involving your customers, buyers, sellers, tenants, contractors, or third parties.

40. Force Majeure and Events Beyond Livenormad's Control

Livenormad will not be liable for any delay, failure, non-performance, increased cost, shortage, damage, disruption, inability to perform, change in service, cancellation, suspension, or other issue caused directly or indirectly by events, circumstances, or causes beyond Livenormad's reasonable control.

Force majeure events include acts of God, fire, flood, storm, extreme weather, natural disaster, pandemic, epidemic, public health emergency, war, terrorism, civil unrest, labour shortage, strike, lockout, supplier shutdown, factory delay, production interruption, material shortage, price escalation, container shortage, port congestion, customs delay, border delay, freight disruption, carrier delay, warehouse delay, government action, import or export restriction, tariff, sanction, change in law, court order, power outage, internet outage, cyberattack, platform outage, payment processor outage, financing provider delay, third-party installer delay, unsafe site condition, customer delay, client non-response, failure to approve, failure to pay, and any other event beyond Livenormad's reasonable control.

Where a force majeure event occurs, Livenormad may extend timelines, suspend performance, adjust pricing, charge additional costs, substitute products, change suppliers, change shipping methods, delay delivery, delay installation, cancel affected portions, or terminate the affected order or service without liability, subject to applicable law.

41. No Guarantee of Permanent Service

Livenormad may change, suspend, discontinue, restructure, sell, transfer, merge, automate, outsource, replace, or terminate any website, platform, dashboard, product line, auction channel, service, program, pricing model, feature, referral program, affiliate program, brokerage program, or business unit at any time. You have no vested right to continued availability of any service, platform, dashboard, program, auction channel, or offer.

42. Chargebacks and Payment Disputes

You agree not to initiate improper chargebacks, payment reversals, or payment disputes for valid charges, deposits, auction purchases, final sale items, custom work, services performed, products ordered, or non-refundable amounts.

Before initiating a chargeback, you agree to contact Livenormad and allow a reasonable opportunity to review and resolve the issue. Improper chargebacks may result in suspension, withholding of delivery, termination of access, recovery of chargeback fees, legal costs, and outstanding amounts.

43. Cancellation and Refunds

Cancellation and refund rights depend on the product, service, order stage, consumer status, applicable law, production status, custom nature of the order, auction or final sale status, design work performed, procurement completed, and costs incurred.

Unless required by applicable law or expressly agreed in writing: custom orders are not refundable once work has begun; design deposits may be non-refundable once design work has begun; production deposits may be non-refundable once production, procurement, sourcing, or supplier coordination has begun; completed custom goods are not refundable because of change of mind; installed products are not refundable because of change of mind; auction items and final sale items are not refundable, returnable, exchangeable, cancellable, or eligible for price adjustment; and shipping, storage, payment processing, financing, third-party installation, and administrative fees may be non-refundable.

44. Warranties and Deficiency Resolution

Livenormad may provide limited warranties or deficiency resolution procedures for certain products or services. Any warranty must be stated in writing.

Unless expressly stated otherwise, warranties do not cover normal wear and tear, misuse, abuse, improper cleaning, improper maintenance, customer damage, third-party installer damage, site conditions, unauthorized modifications, colour variation, natural material variation, minor dimensional variation, damage after delivery, failure to follow care instructions, electrical or structural issues, or products moved or reinstalled by others.

45. Communications

Livenormad may communicate with you by email, text message, phone, WhatsApp, dashboard message, invoice note, website notice, platform notification, mail, or other reasonable methods. You consent to receive transactional communications related to your account, order, quote, payment, production, delivery, installation, auction purchase, referral, affiliate account, brokerage account, or service request.

46. Termination

Livenormad may suspend, restrict, or terminate your account, dashboard access, order access, auction access, referral access, affiliate access, brokerage access, or platform access at any time where Livenormad believes termination is appropriate, including for breach, non-payment, fraud, misrepresentation, chargeback abuse, security risk, platform misuse, auction manipulation, reputational harm, legal risk, business risk, discontinued services, or any other reasonable reason.

Termination does not affect amounts owed, accrued rights, intellectual property rights, indemnities, limitation of liability, dispute provisions, confidentiality obligations, payment obligations, or provisions intended to survive termination.

47. Governing Law

These Terms and any dispute arising from or related to Livenormad, its websites, services, products, platforms, dashboards, orders, designs, renders, installations, referrals, affiliates, auctions, partnerships, or transactions will be governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict of law principles, except where mandatory consumer protection law requires otherwise.

48. Dispute Resolution

Before starting legal proceedings, you agree to first contact Livenormad in writing and provide a reasonable opportunity to resolve the dispute informally.

For commercial users, business users, affiliates, referral partners, brokerages, real estate professionals, contractors, suppliers, and non-consumer transactions, Livenormad may require disputes to be resolved by confidential mediation or arbitration in Alberta, unless Livenormad elects to pursue court proceedings for unpaid amounts, injunctive relief, intellectual property protection, fraud, confidential information, or urgent remedies.

For consumer transactions, nothing in these Terms limits any non-waivable right to bring a claim, complaint, or court proceeding where such right cannot be waived under applicable consumer protection law.

49. Venue

Subject to applicable law, you agree that any court proceeding relating to Livenormad, these Terms, or any transaction with Livenormad must be brought in the courts of Alberta, Canada. You agree not to object to Alberta as the forum on the basis of inconvenience, lack of connection, or similar grounds, except where prohibited by applicable law.

50. Class Action Waiver

To the maximum extent permitted by law, disputes must be brought on an individual basis and not as a class, collective, representative, or group proceeding. This provision applies only to the extent permitted by applicable law and does not limit any rights that cannot legally be waived.

51. No Agency, Partnership, or Joint Venture

Nothing in these Terms creates a partnership, joint venture, employment relationship, franchise, fiduciary relationship, agency relationship, or representative relationship between you and Livenormad. Referral partners, affiliates, contractors, installers, real estate agents, brokerages, suppliers, and service providers are independent from Livenormad unless expressly stated otherwise in a written agreement signed by Livenormad.

52. Assignment

You may not assign or transfer your rights or obligations under these Terms without Livenormad's prior written consent. Livenormad may assign, transfer, subcontract, delegate, sell, merge, license, or otherwise transfer any rights, obligations, contracts, accounts, orders, platforms, data, intellectual property, or business operations to an affiliate, successor, purchaser, lender, investor, contractor, service provider, or third party.

53. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable. If modification is not possible, the provision will be severed, and the remaining Terms will continue in full force.

54. Waiver

Livenormad's failure to enforce any provision of these Terms does not waive its right to enforce that provision later. Any waiver must be in writing and signed by Livenormad.

55. Entire Agreement

These Terms, together with any quotation, invoice, order form, dashboard approval, auction listing, final sale term, service agreement, installation agreement, privacy policy, refund policy, warranty policy, referral policy, affiliate policy, brokerage program policy, or other written terms incorporated by reference, form the entire agreement between you and Livenormad regarding the applicable transaction.

56. Survival

Any provision that by its nature should survive termination will survive indefinitely to the maximum extent permitted by law, including provisions relating to payment, deposits, auction purchases, final sale items, intellectual property, user content, installation liability, third-party contractors, indemnity, limitation of liability, force majeure, dispute resolution, governing law, confidentiality, records, and remedies.

58. Acceptance

By accessing Livenormad's websites, using its platforms, requesting a quote, paying a deposit, approving a design, using a dashboard, placing an order, accepting an invoice, participating in an auction, purchasing a final sale item, participating in a referral or affiliate program, requesting installation coordination, working with a recommended third-party installer, or otherwise dealing with Livenormad, you confirm that you have read, understood, and agreed to these Terms.
